Is the defalt Textures and Sprites legal to use?

I did read the Making Money sticky thread, but all I want to know is if we are allowed to use the defalt Textures (Tiles, Sprites, etc..) and charge users a subscription fee for some of it.

The tilesets and sprites do not belong to Eclipse, and they are copyrighted to the ppl that made RMXP.

We use them as templates, but nothing more.

If you made the sprites/tilesets, etc, yes; you can make as much money off your game as you want ;)
